[Plugin: MD Table of Contents Generator] Suggestion–don't use H1 as TOC title

I tried a number of different Table of Contents plugins and I would like yours the best, except for one little problem.
I would say: please don’t have the TOC title as an H1 tag. According to web design standards, header tags need to follow a logical structure showing the outline of the content:
H1
H2
H2
H3
With only one H1 tag, and with header tags following the proper nesting pattern without being out of order. Having a surplus H1 tag thrown into the middle of the page breaks several of these rules. An H1 tag is also a valuable area for SEO keywords, so I don’t want it used for “Table of Contents” on every page ??Other than that, some extra possible suggestions, although I expect these are out of the range of what you’re looking to do:
Could you have the shortcode work in an HTML comment? If a plugin is disabled or if I switched TOC plugins, then suddenly I would have [toc] tags visible to viewers scattered among many pages, each of which would have to be removed one by one.
Is there a way to have the TOC generated automatically for all posts and pages? I know it would take a lot of work, but my dream TOC plugin would have a page where I could say something like, for example, “generate TOCs for all pages and all posts, except posts in the portfolio category and the “About” page, as long as there are at least three header tags on the page or post.” Then bam, whether I had dozens or hundreds of posts and pages, all the appropriate pages and posts would have an automatically generated, attractive TOC. That would be AWESOME!
