Active sub sub page link has empty under

I am using the BE Subpage plugin. Everything is working, but I have a small display issue. I have sub pages with sub sub pages in it. When I click on a sub sub page I get empty unordered list tag displaying before the next list item. This causes extra space to be added before the next sub sub page link.

Any ides on how to fix this, so the extra space is not added?
