Aeros 2.0 theme (GPL!) derivate?

I’ve seen that recently the Aeros theme has disappeared from the WordPress themes’ Repository and from the author website as well:
sadly it seems to have become a commercial theme …As the theme, up to the 2.0 version, was released under the GPL 3

what about starting a aeros-free ‘derivative work’?
or at least, would it be possible keeping the last GPLed version on the repository?
