Annoying captcha notice (does it comply with TOS?)

We appreciate your concern for users to use the captcha to avoid CC fraud but the inability to turn off the admin notice that appears everywhere in the admin dash interface is really too much. Give admin ability to dismiss notice either permanently or for 24 hours. At the very least if admin dismisses notice X it should not appear within the same admin user session. Does this notice that can not be removed by admin comply with WordPress developer TOS for plugins?
