extra list under top level category?

Hi there, for some reason the script creates an extra list tag under the top level category, and it doesnt show on firefox and safari, but it does on internet explorer. I have it styled with no bullet so its just an extra blank line at the top of the list within the category. Any thoughts on how to get rid of this?
