Image Issue with Free Theme

Got a notification from an image company regarding an image that was used in a free theme within the WordPress repository. No modifications to theme and clear notification of what theme was being used was left in the footer. The image in question appears that the theme author cropped out a tree from the image which is not even 10% of the image. Anyone else get something like this? and interested in suggestions of what other may have done with this.
