menu icon iphone not working?!

why so if the list of menu items is below the fold?

Sorry I can’t answer this, this is a design decision. I can help with support topics.

It just seems strange that by design what a user sees is a Menu icon with a cross next to it.

When I first saw that I thought the cross indicated an error of some kind and only by chance did I later scroll down and see the list of menu items!

Is there a process for me to bring this to those involved in the design of the theme?

That’s okay, if you want you can edit your post within 60 minutes from when it was made. Coincidentally I’m helping someone out with a similar issue. They find it odd that the menu is so far down so I’m suggesting some code to reduce the height of the image.
