Not all post in sitemap if ?Scheduled? posted publication

I understood what the problem is.

Because of this code in the functions.php theme:

function exclude_category($query) {
    if ( $query->is_home ) {
        $query->set('category__not_in', array(76, 90, 96));
    }
    return $query;
}
add_filter('pre_get_posts', 'exclude_category');

Posts are not included if the publication is made using ?Scheduled?.

It can be fixed?
