remove footer spam links w/o disabling theme

I am using a free theme. When I downloaded the theme, I did not see anywhere that it was free IF you left the spam on it. In fact, I still don’t. This is where I downloaded it:

I don’t mind giving the author credit… but I do not want these links on my site. If you remove them, it disables the theme. Of course, I didn’t start working on the footer until I had a good start to the rest of the mods I was making.

Anyone know of a similar theme layout that doesn’t require you to have spam links on it? Or, is there a hack I can use to get around it? I’m *this* close to changing the font color, but I don’t want to get in trouble with Google. I’m so irritated that this author would advertise a theme as free when it is not (ie: spam).
