I must agree, the button is there but it’s broken. it does not matter whether it’s checked or not it still there on the front-end. 
EDIT: Oh no wait! What i covered in here is the terms and conditions, what I mean is the privacy policy! How can we turn thaaat off? ??
EDIT2:
To get rid of the privacy policy checkbox, you have to go to thw WordPress Dashboard Settings menu/privacy, and set “Select a Privacy Policy page” to “—Select —” Then the checkbox automatically disappears.
