Subscribes even after checkout validation errors

If there are validation errors on the checkout fields, the subscription still takes effect. So if, for example, a user has 3 attempts at filling out the checkout form before getting it right, they will receive 3 “Confirm your subscription” emails.
It would be better if the subscription would only occur after successful checkout validation.
