Theme broke sense wordpress 3.0

I was using a call to my wordpress header, footer, and sidebar to display on the non-wordpress side of my website. It was working until I upgraded to WP 3.0. Now I get the following error.

Warning: file_get_contents(https://www.gearupandplay.com/inc-bans-header2.php) [function.file-get-contents]: failed to open stream: HTTP request failed! HTTP/1.1 404 Not Found in /home/mfalk75/public_html/shop/themes/bans-bp-daily/header.php on line 30

I don’t know how to fix this or what it is. This was working. Is the function file_get_contents just not working now? Any help would be appreciated.
