Hello,
Thanks for your comments. It’s good to see how others interpret GDPR.
We’ve found the guidance given by the Information Commissioner’s Office (ICO) in the UK very helpful.
This is a useful document: https://ico.org.uk/media/about-the-ico/consultations/2013551/draft-gdpr-consent-guidance-for-consultation-201703.pdf
It refers to Recital 42 which says: “Consent should not be regarded as freely given if the data subject has no genuine or free choice or is unable to refuse or withdraw consent without detriment.”
This is also another very helpful document from the ICO on Cookie Guidance:
https://ico.org.uk/media/for-organisations/documents/1545/cookies_guidance.pdf
In this document it states that “Whether those choices are at browser level or site specific it must always be possible for the user to decline to accept cookies even if it means a site’s functionality is limited for the user as a result.”
You can see here that if a user declines cookies then it could potentially limit the functionality as a result which is a choice that the user has. However, we prefer it if users do not suffer a detriment as a result of not giving consent because if declining cookies means that the user has a detrimental experience of your website, it could be interpreted that the user did not have a free choice. With this in mind, we have designed this plugin to give the user full control and ensure that user’s consent was given freely.
We strongly suggest that you seek an independent advice and setup the plugin according to your own interpretation of GDPR.
Hope this helps.
Thanks,
Moove Agency
