I finally get this to work, this how i did if its helpful for someone, first open another browser to see its working, i recommend open a anonymous chrome and another browser too, because if you try this with a logged admin its not going to work.

under settings – general (free downloads)
select the option allow download on shop/archive page

now under membership section (you need the woocommerce membership plugin)
    select the option members only

now create two categories – free and paid (do it first)

    create paid plan
-> here is the trick -> when you create a paid plan, go to restrict products, select the right categorie and under -> only members can, set to purchase, if you set to view i’ll redirect the user to the page you set in woocommerce membership

    create the free plan

-> in grant acess upon – set to user account registration

-> go to restrict products, select products categories and select free categorie you set, and in only members can (set to purchase)

this away if a user don’t have a premium membership its allow to download only the files you set to the free categorie, but i also wanted to make this free categorie avaliable to user that don’t even have a account, to do that you have to select the Disable restrictions in the product creation page. its on the bottom of the page
