Modernizr does not collect any user data of any kind. It only performs one or more tests determining capabilities of the current browser, and makes that information available to the website itself (which a designer or developer can use by anticipating it).
As best we can tell, Modernizr does not affect GDPR in any way. Please note, however, that none of us are lawyers.
